Is murder a crime in war?

Is murder a crime in war? when the victim is considered a sub-human by the occupier? when the murderer is one of the occupiers? when millions or other so-called "sub-humans" are killed legally does it matter that one "sub-human" social deviant ie prostitute is killed by one of the elite members of the power in control? Does a criminal police officer have to excuse the actions, otherwise illegal, of someone of high position & importance to the war effort? or does he have the responsibility to lay blame where it belongs? at what point does it become illegal to kill one of the " enemy"? a question and a film worth considering/viewing today, no?
